four.1) Description

Award of a contract without prior publication of a call for competition in the cases listed below

Explanation:

The Contract was awarded to Briggs Equipment UK Limited (Briggs) pursuant to Regulation 50(1)(c)(ii) of the Utilities Contracts Regulations 2016 (the Regulations). For the reasons set out below, Warrenpoint Harbour Authority (WHA) is of the view that the Contract could only be awarded to Briggs because competition was absent for technical reasons, and no reasonable alternative exists.

Having undertaken research on the forkilifts available in the market, WHA is of the view that the Combilift C16000 is the only product in the market that is capable of fulfilling its technical and health and safety requirements, due to its multi-directional , side loading, 900mm load-base and load lifting capacity, which will enable consistent low level carriage of steel beams within spatially constrained aisles in WHA's steelyard. WHA understand that the C16000 is the only multi-directional forklift in the market with a 16 tonne capacity. WHA have been informed by Combilift that Briggs is the relevant sales agent from whom WHA can purchase the C16000s that meet its technical requirements.

In light of the above, WHA is of the view that if it were to have put the contract opportunity out to tender in accordance with the Regulations genuine competition for it would have been absent, and in the circumstances there is no reasonable alternative to the Combilift C16000.
