six.3) Additional information

This is a Provider Selection Regime (PSR) contract modification notice. This contract has been modified under the urgent circumstances provision of the Health Care Services (Provider Selection Regime) Regulations 2023. For the avoidance of doubt, the provisions of the Public Contracts Regulations 2015 do not apply to this award. This contract has now been formally modified.

The modification made changed the end date of the contract to 31st May 2024, adjusting the financial envelope by £666,633.50.

Conflicts of Interest have been sought by relevant decision makers and none were noted. The final decision was approved by the Director of Commissioning - Urgent and Elective Care.

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

This award was made in what the relevant authority considered to be urgent circumstances. The modification extends the existing contract by 2 months, effective 1st April 2024- 31st May 2024 to allow for continued service provision while a new contract is put in place for the period 1st June 2024- 31st March 2025.

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee.

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Negotiations to agree the terms of a contract for 24/25 have taken longer than expected. The relevant authority considers that it is not possible to satisfy the requirements of regulations 6 to 13 before the term of the existing contract expires and needs to ensure there is service provision in place.
