This contract has been awarded under the urgent circumstances provision of the Provider Selection Regime (PSR). This contract has been awarded under the Health Care Services (Provider Selection Regime) Regulations 2023. For the avoidance of doubt, the provisions of the Public Contracts Regulations 2015 do not apply to this award.

An urgent award is required for this contract due to significant concerns having arisen in relation to delivery of the services that could not be recovered with the existing provider. A compliant approach to re-allocating them was planned. At a late stage in preparations, however, the parties to this contract have confirmed that they are not in a position to take this forward. Ensuring essential continuity of patient care requires that the services be rapidly mobilised by the end of March 2024.

Livewell Southwest CIC have been identified as able to deliver the services with immediate effect, including transfer of staff, and to a high standard.

An initial contract period of 12 months has been applied to enable stabilisation of the services following the issues outlined and then review of the most appropriate procurement approach going forward. The 12 month extension option has been included to allow sufficient time for a full competative process, including mobilisation, should this be confirmed as required.
