This includes, but is not limited to the stack, booster system, control system and associated parts.

We may extend this Agreement for up to 24 months by giving You six months' notice in writing which notice expires no later than the Expiry Date. The extension may be provided in any manner in so far as it does not exceed 24 months. For example 12 months + 12 months.

Explanation:
The award of the contract is lawful in accordance with regulation 32 of the Public Contract Regulations 2015 (as amended) as competition is absent for the following technical reasons.
Due to the propriety of the software and hardware which is interconnected, to award a contract to another provider would require the hardware and monitoring system to be replaced in total at an estimated cost of £150,000 to £200,000 per Council. The Councils do not have budget for the replacement of this equipment.
Due to the existing software it negates the Councils' ability to undertake a competitive procurement with other specialist companies as a different monitoring system would not be able to connect with the existing hardware.
The expected value of the contract for the maximum five year term (inclusive of extensions) is £115,000 which is below the Public Contracts Regulations 2015 (as amended) threshold £189,330. Therefore, the award of the contract is outside of scope of the Public Contracts Regulations 2015 (as amended). The Councils have undertaken to issue a Voluntary Ex Ante Notice in line with their own aims on transparency.
