four.1) Description

four.1.1) Type of procedure

Award of a contract without prior publication of a call for competition in the cases listed below

  • Extreme urgency brought about by events unforeseeable for the contracting authority

Explanation:

There are derogations under the regulations to award a contract to a single supplier where the supplies or services can only be supplied by a particular supplier for the following reason:-

i) in cases of extreme urgency brought about by events unforeseen or attributable to the contracting authority, where the time limits for the open, restricted or competitive procedures with negotiation cannot be compiled with (regulation 32(2)(c)).

Due to unforeseen circumstances the Equality Commission will be without IT support from the end of March and it would not be possible to complete a competitive tender exercise given the timescales involved. This award is for a short term DAC (for a period of up to one year) to provide cover until a new service model can be established (either via internal NICS IT service provision or following a competitive tender exercise). The technical complexities

together with the timescales / duration appear to suggest that the contract would not be a viable commercial opportunity for the market.

If, after the specified. time, they still fail to reach satisfactory. levels of contract performance, the matter will be. escalated to senior management in construction and procurement delivery (CPD) for. further. action. If this occurs and their performance still does not improve to satisfactory levels. within the specified period, this may be. considered grounds for termination of the contract at. your expense as provided for in the Conditions of Contract.
