seven.2) Information about modifications

seven.2.1) Description of the modifications

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

This contract was a call-off contract awarded under Lot 8 of the CPD Framework ID 1032027

for Legal Services.

The contract was previously modified in November 2022 to increase the value by 50% of the original awarded contract value (2022/S 000-033436), and was further modified in July 2024 to extend the contract period by 7 months until 31 March 2025 and increase the value by 50% of the original awarded contract value (2024/S 000-012747).

The requirement has arisen to modify the contract end date to extend for a further period of

2 years until 31 March 2027 and increase the value by up to 50% of the original awarded contract value to cover this additional contract period.

The modification is proposed in accordance with Regulation 72 (1)(b) and meets all of the following conditions:

(b) for additional works, services or supplies by the original contractor that have become

necessary and were not included in the initial procurement, where a change of contractor—

(i) cannot be made for economic or technical reasons such as requirements of

interchangeability or interoperability with existing equipment, services or installations

procured under the initial procurement, or

(ii) would cause significant inconvenience or substantial duplication of costs for the

contracting authority, provided that any increase in price does not exceed 50% of the value

of the original contract;

Need for additional works, services or supplies by the original contractor/concessionaire.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

For technical reasons a change in supplier is not possible at this stage. The provider has been contracted to provide programme assistance and support on the EdIS Programme and has built up critical knowledge and understanding which will be required to ensure the continuity of the service provision as this will be essential to support the project teams going forward in the delivery of the remaining EdIS programme projects including the new procurement exercise now required following the unforeseen termination of the Strategic Partner and School Management System Contract, which is expected to take approx. 2 years to complete. To contract with a different supplier at this stage would significantly impact timelines for delivery of projects and duplication of costs for the contracting authority.
