The procurement of Targeted Prevention for Sexual and Reproductive Health services has been delayed due to a range of factors beyond Torbay Council's control since 2017/18. In order to bring the outstanding prevention services in line with timescales for the main clinical contracts, as well as deliver system improvements in a timely manner, the Council is proposing to award the following Lots which combine to form the Targeted Prevention for Sexual and Reproductive Health service:

Lot Two - Condom Distribution Scheme

Individually and as a combined service the value of these contracts sits below the threshold for regulated procurement, this notice is being published to ensure that the contract awards meet the requirements set out within Torbay Council's internal governance framework in respect of exemption from the application of Contract Procedures.

two.2.4) Description of the procurement

The workforce training programme will enable specialist workforces, including the children and young people’s workforce across all sectors to improve interventions with residents around relationships and sexual wellbeing.

Community based interventions will take an intelligence led approach to identifying key groups and communities most likely to engage in riskier sexual behaviours and poor reproductive and health outcomes. This could include those with multiple or concurrent partners, older adults, sex workers and people with multiple and complex needs. Interventions will be time bound and outcome focussed.

The initial term of the main clinical sexual and reproductive health contract runs until 30 June 2023 with the option to extend on + 1 + 1 basis. two.2.4) Description of the procurement

The aim of the contract is to prevent poor sexual and reproductive health amongst the population of Torbay.

In accordance with the Health and Social Care Act 2012 certain public health responsibilities were transferred from the NHS to Local Authorities in 2013. Torbay Council has a legal duty to take action to improve the health and wellbeing of residents and to reduce differences in health outcomes (health inequalities) between different groups of people.

The prevention services will provide a condom distribution scheme for 13-24 year olds in Torbay and seek to improve knowledge, skills and access to preventing poor sexual and reproductive health outcomes. This will include a robust digital offer and appropriate marketing campaigns aimed at sexually active young adults.

four.1) Description

four.1.1) Type of procedure

Award of a contract without prior publication of a call for competition in the cases listed below

Explanation:

Individually and as a combined service the value of these contracts sits below the threshold for regulated procurement of social and other specific services. This notice is being published to ensure the contract awards meet the requirements set out within Torbay Council's internal governance framework in respect of exemption from the application of Contract Procedures.

A tender notice (2017/S 182-373398) under social and other specific services was published in OJEU on 18 May 2017 for two interconnected services - (A) Integrated Sexual and Reproductive Health Service and (B) Targeted Sexual and Reproductive Health Prevention Service, but the tender process in respect of (B) was not completed. The services detailed under this VEAT notice comprise the provision which would have sat within (B) had the contract been awarded. Since early 2018 Torbay Council has been working to retender the Targeted Sexual and Reproductive Health Prevention Service. This work has experienced delays to enable public consultation on a revised scope, the outcome of that consultation and budget reductions. More recently the impact of COVID-19 has resulted in a lack of internal resource and market capacity to respond to a tender process. Current provision is based on services in place prior to the 2017 tender which are no longer fit for purpose. Subject to the outcome of this VEAT notice and approval through its internal governance mechanisms Torbay Council intends to:

• Directly award a new contract to the incumbent provider in respect of Workforce training and Community based interventions, who are in the best position to maintain continuity of service whilst undertaking the remodelling required under the revised specification (Lot 1).

• Modify the contract of the current provider of the Integrated Sexual and Reproductive Health Service awarded following the 2017/2018 tender process, to include the Condom Distribution Scheme. The incumbent provider has been fully consulted on this approach (Lot 2).

The long-term intention is to include these services within the re-procurement of the Integrated Sexual and Reproductive Health Service, at which point the Council will be in a position to fully understand the budget and requirements for the provision moving forwards. Although it may be that the decision is taken to tender these services as standalone provision at some during the intervening period.
