This contract has been awarded under the urgent circumstances provision of the Provider Selection Regime (PSR). This contract has been awarded under the Health Care Services (Provider Selection Regime) Regulations 2023. For the avoidance of doubt, the provisions of the Public Contracts Regulations 2015 or the Procurement Act 2023 do not apply to this award.
Pathway Associates are the longstanding existing provider for this service that has previously been delivered under a spot purchase agreement which was a compliant route under the previous procurement legislation. An urgent contract was awarded to end in August 2025 under the new PSR regulations to allow for a procurement process to take place for a 3-year contract. With the new proposed changes to ICB functions (as outlined in the ICB blueprint provided by NHSE), it is currently unknown whether CETRs will remain a statutory responsibility for the ICB.
Therefore, the intention to go out to procurement to award a longer-term contract has been put on hold and a short-term arrangement is required until the ICB know more about whether CETRs will remain within their responsibility. If the arrangements with the existing provider are not extended, this would result in a gap in provision which would result in a risk to patients and the non-delivery of the ICB's current statutory duty.
The ICB's Acting CFO approved this urgent award on the 30/07/2025.
