Description of risks to contract performance

1. Adverse weather event o A significant poor weather event at sea could cause loss and/or damage to WaveRider equipment, resulting in damage and/or replacement requirement beyond that accounted for in the Contract. o This could result in additional parts and services required from the Supplier and therefore additional costs. o Unable to address the risk upfront as weather is beyond control of Buyer or Supplier (other than through proportionate mitigation for some weather risk which is provided for in the Contract). o Risk assigned to Buyer and Supplier. 2. Vessel / infrastructure collision o A vessel or other infrastructure collision at sea could cause loss and/or damage to WaveRider equipment, resulting in damage and/or replacement requirement beyond that accounted for in the Contract. o This could result in additional parts and services required from the Supplier and therefore additional costs. o Unable to address the risk upfront as operation of third party vessels is beyond control of Buyer or Supplier. Mitigations to minimise an incident as best as possible are in place including guard buoys. o Risk assigned to Buyer and Supplier 3. Addition of new WaveRider equipment o Requirement to add new WaveRider equipment to new sites at sea due to increased demand for monitoring. o This could result in additional maintenance requirements for the new equipment and therefore additional costs. o Risk assigned to Buyer.

Single supplier - technical reasons

The UK WaveNet monitoring program, is built on a fleet of DataWell (hardware equipment supplier) wave riders as the gold standard ultra-reliable monitoring device. As well as the required capital investment to replace this existing equipment, a change of platform would be prohibitively expensive and would also need approval from our customer (EA and UKCMF) in order to ensure Cefas was meeting it's contractual obligations. As such the continues use of the DWR Mk3 instruments is essential, and RS Aqua is the only UK representative for DataWell to provide the necessary calibration and maintenance and servicing requirements.
