Section four. Procedure

four.1) Description

four.1.1) Type of procedure

Award of a contract without prior publication of a call for competition in the cases listed below

  • No tenders or no suitable tenders/requests to participate in response to open procedure

Explanation:

Following a review of all bid submissions it was identified that there were issues with the proposals of all bidders that resulted in no compliant bid submissions. The issues were that all bidders failed to propose products that met the safety requirements outlined within the specification. The specification identified that all PPE must be supplied to CE and EN standards where applicable to meet the new E.U. regulations. As the PPE regulation 2016/425 impacts garments manufactured after 21 April 2019, many products were proposed that were manufactured against the regulations that were in place prior and therefore did not meet the required standards. There were also issues with the protective trousers and jacket, and the high-vis garments not meeting the required safety standards.

Therefore the Authority entered in to a negotiation without prior publication with the now contractor.
