Buckinghamshire, Oxfordshire and Berkshire West ICB (formerly Oxfordshire Clinical Commissioning) commission a Community Endoscopy service for patients registered with a GP in Oxfordshire in order to deliver a safe and clinically effective service that would provide rapid local access to diagnostic endoscopy for patients that will include gastroscopy, colonoscopy and flexible sigmoidoscopy. The total contract value at the time of conclusion to the procurement over the 5-year term is £15,499,800 with an initial contract period of 3 years plus an optional extension of any period up to 2 years. This was originally procured with the support of NHS South, Central and West Commissioning Support Unit (SCW) on behalf of the Commissioner

This contract has been modified under the urgent circumstances provision of the Health Care Services (Provider Selection Regime) Regulations 2023. For the avoidance of doubt, the provisions of the Public Contracts Regulations 2015 do not apply to this award. This contract has now been formally modified.

The initial contract period of 3 years ends on 31st March 2025, with an optional extension of any period up to 2 years.

seven.2) Information about modifications

seven.2.1) Description of the modifications

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

The contract had a local price at circa 75% of tariff when the contract commenced. Since then, we have had a period of unprecedented inflation and no uplifts to the contract. The provider could not sustain the tariff in their bid and advised that they would need to terminate the contract if the Commissioner would not agree to the national tariff + MFF. The Commissioner agreed, under Regulation 14, to modify this contract due to these urgent circumstances to ensure continuity of this critical service to patients.

The value of the contract was originally £15,499,510 over the full 5 year contract period, with a modified contract value of £20,168,366 (calculated as 1yr + 9 mths at the agreed tariff at procurement and 3 years + 3 months at full National tariff + MFF from 1st Jan 2024 up to and including the contract extension -31st March 2027)

The modification has been actioned from 1st January 2024.The Commissioner is in the process of reviewing this contract and aims to ensure decisions on procurement options are made prior to the end of the initial 3-year period of the contract.

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee.

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

The contract had a local price at circa 75% of tariff when the contract commenced. Since then, we have had a period of unprecedented inflation and no uplifts to the contract. The provider could not sustain the tariff in their bid and advised that they would need to terminate the contract if the Commissioner would not agree to the national tariff + MFF. The Commissioner agreed, under Regulation 14, to modify this contract due to these urgent circumstances to ensure continuity of this critical service to patients.
