Section six. Complementary information
six.3) Additional information
This contract has been awarded under the urgent circumstances provision of the Provider Selection Regime (PSR). This contract has been awarded under the Health Care Services (Provider Selection Regime) Regulations 2023. For the avoidance of doubt, the provisions of the Public Contracts Regulations 2015 do not apply to this award.
Pathway Associates are the longstanding existing provider for this service that has previously been conducted under a spot purchase agreement. The introduction of the PSR resulted in the ICB having to consider a compliant PSR route for the future commissioning of this service, to replace the current spot purchasing arrangement, under very tight timescales. An urgent short term solution was required to allow the timescales to consider the most suitable PSR route for the longer term contracting arrangements. The ICB have met the requirements within the PSR guidance for an urgent award and delaying the award of the contract and creating a gap in service provision to conduct a full application of the PSR would have posed a risk to patient safety and the non-delivery of the ICB's statutory duty, as CETRs are a statutory responsibility.
The ICB's CFO approved this urgent award on the 03/10/2024.
No conflicts were declared.
