Explanation:

The Air Commodities Delivery Team (ACDT), part of the UK Ministry of Defence (MoD), intends to place a new 7 year Contract with Amsafe Birdport Ltd (Amsafe) for post design services and technical support to the MoD’s existing requirement of Cargo Nets/Helicopter Underslung Load Equipment from 1st January 2022. The estimated Contract value is £25M.

It is considered that this Contract can be placed using the negotiated procedure without prior publication of a contract notice pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations (DSPCR) of 2011). This is due to the technical impracticality for another economic operator to undertake the work required within this contract. Only Amsafe hold manufacturing information and technical expertise necessary to provide the required services. In addition, no other supplier will be able to provide said services within the timescales required and meet the MoD’s MAA standards. To contract with another supplier would create an unacceptable safety risk for the MOD.
