two.2.4) Description of the procurement

This is a voluntary Prior Information Notice (PIN) for services likely to be procured in relation to the provision of rail passenger services and other related services for Docklands Light Railway, Elizabeth Line and London Overground. The purpose of this notice is to alert the supplier community to these potential opportunities, and to assist Transport for London with developing aspects of its procurement strategy.

1. The purpose of this PIN is to:

(a) alert potential suppliers to opportunities in relation to the provision of rail passenger services for:

(i) Docklands Light Railway

(ii) Elizabeth Line

(iii) London Overground

(b) inform potential suppliers of possible early market engagement arrangements in relation to the procurement of rail passenger services and other related services for Docklands Light Railway, Elizabeth Line and London Overground; and

(c) invite potential suppliers to register an expression of interest in taking part in any market engagement exercise and/or participating in any subsequent procurement process.

2. Transport for London, through its subsidiary companies, Docklands Light Railway Limited (DLRL) and Rail for London Limited (RfL), may wish to undertake early market engagement in relation to its proposals for the procurement of rail passenger services and other related services.

3. The purpose of any early market engagement would be to receive market feedback that may be used to assist DLRL and RfL in understanding the current supply market and to help scope and structure their respective requirements for the procurement of rail passenger services and other related services for Docklands Light Railway, Elizabeth Line and London Overground.

4. The precise nature of any such early market engagement will be determined by DLRL and RfL, which may take the form of a supplier briefing day and/or other direct engagement with potential suppliers either collectively or on a one-to-one basis.

5. Should DLRL and/or RfL wish to hold a supplier briefing day or any other similar industry day, it is anticipated that this would be held in late May or early June 2023

6. Potential suppliers interested in taking part in any market engagement exercise and/or participating in any subsequent procurement process are requested to express an interest by following the instructions detailed in section VI.1 and TfL will provide details of any proposed early market engagement.

six.1) Additional information

1. Any parties interested in taking part in any market engagement exercise are required to register their interest by emailing TfLRailProcurements@tfl.gov.uk and providing details of your organisation and key contact details.

2. Any parties interested in taking part in any subsequent procurement process are requested to register their interest by emailing TfLRailProcurements@tfl.gov.uk and providing details of your organisation and key contact details.

3. Neither the registration or non-registration of interest nor the participation or non-participation in any early market engagement will advantage or disadvantage any supplier's ability to participate in any future procurement activity.

4. This PIN does not formally signify the beginning of a procurement and does not constitute a commitment by TfL or any of its subsidiaries to undertake any procurement exercise. In the event that TfL decides to formally commence the procurement of the DLR Franchise Agreement, or the Elizabeth Line or London Overground Concession Agreements separate contract notices will be issued.

5. TfL (including any of its subsidiaries) will not enter into a contract based solely on the responses to this PIN or any subsequent early market engagement exercise and no information contained in this document or in any communication made between TfL, its subsidiaries or advisers and any supplier in connection with this PIN or any early market engagement exercise shall be relied upon as constituting a contract, agreement or representation that any contract shall be offered in accordance with this PIN.

6. Potential suppliers shall be solely responsible for any costs which they incur as a result of responding to this PIN and participating in any aspect of any subsequent early market engagement exercise or procurement process.

7. This PIN is being issued in a substantially similar form on both forms T01 and F04 on the same date. This is because procurement of Docklands Light Railway services is currently expected to be undertaken under the Utilities Contracts Regulations 2016, whereas procurement of Elizabeth line and London Overground services is currently expected to be undertaken under regulation 1370/2007 (as that regulation forms part of retained EU law). However, Transport for London considers there to be potential advantages and efficiencies of undertaking possible early market engagement concurrently for Docklands Light Railway, Elizabeth Line and London Overground services.

8. As applicable for the purposes of this notice, the Start date, Duration in months and Estimated date of publication of contract notice relate to the possible Docklands Light Railway procurement, are included for indicative purposes only and are subject to change. As part of any possible early market engagement, Transport for London (including DLR and RfL) would expect to engage with potential suppliers in relation to some or all of these matters and therefore these are subject to possible amendment.
