Derbyshire County Council (The Council) Children’s Services Catering Service is seeking a

supplier for the provision of the supply and delivery of bread products for schools and

establishments located within the geographical area of Derbyshire and neighbouring

counties.

Derbyshire County Council’s Catering Service is one of the largest specialist education

caterers in the country, serving around 60,000 meals to school pupils daily.

The contract shall be for an initial 3-year period commencing on 5th June 2023, with the

option to extend for two further one-year periods, up to a maximum of 5 years.

Justification:

Due to the short timeframe prior to the contract start date, resulting from the inability to award a contract based on the compliance of submissions received for a previous tendering opportunity CCS005, the Council is exercising the powers conferred by regulation 27(5) to utilise accelerated procedure fix a time limit for the receipt of tenders that is shorter than the minimum specified in regulation 27(2).

Derbyshire County Council will incorporate a minimum 10 calendar days (or 15 if non electronic or fax methods used) standstill period at the point information on the award of the contract is communicated to the relevant economic operators. Debriefing by the Council shall be in accordance with the Public Contracts Regulation 2015 (as amended) (the Regulations). Such information should be requested from the addressee in Section 1.1. If an appeal regarding the award of the contract has not been successfully resolved the Regulations provide for the aggrieved parties who are of the opinion that they have been harmed or are at risk of harm by a breach of the Regulations, to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought as soon as possible.
