Explanation:
The United Kingdom Ministry of Defence, intends to award a contract to Teledyne Caris Inc. (“Caris”) for the supply and maintenance of specialist software to support the analysis, formatting and correction of data gathered by hydrographic sonar systems on board Royal Naval (“RN”) vessels (the “Contract”). The Contract will have a duration of 5 years plus 1 option year.
It is considered that this Contract can be placed using the negotiated procedure without prior publication pursuant to Article 32(2)(b)(ii) of Directive 2014/24/EU (Regulation 32(2)(b)(ii) of the Public Contract Regulations 2015 (SI 2015/102) on the basis that the relevant products and services can be supplied only by Caris, competition being absent for technical reasons. To award the Contract to any other economic operator would have a major impact on operations as well as quality of survey data outputs, hence Safety of life At Sea (SOLAS) charting obligations and military specific bathymetric requirements provided by the Royal Navy for navigational and operational safety. There would also be an impact on Training causing severe disruption and a significant change in the Flag Officer Sea Training (FOST) Hydrographer Meteorologists (HM) course and syllabuses which would cause a reduction of the timely output of training the HM Fleet.
