This contract is being modified in accordance with Regulation 72.1.b. of the Public Contracts Regulations 2015. The modification will extend the contract for the Provision of Homecare Services for Kensington and Chelsea from 01.12.2024 to 30.04.2025, 5 months.
The contracting authority is relying on Regulation 72.1. b. due to economic and technical reasons connected with the exclusive rights and that a change of contractor would cause significant inconvenience or substantial duplication of costs for the contracting authority.

seven.2) Information about modifications
seven.2.1) Description of the modifications
Nature and extent of the modifications (with indication of possible earlier changes to the contract):
These contracts are being modified in accordance with Regulation 72.1.b. of the Public Contracts Regulations 2015. The modification will extend the contract for the Provision of Homecare Services for Kensington and Chelsea from 01.12.2024 to 30.04.2025, 5 months.
The contracting authority is relying on Regulation 72.1. b. due to economic and technical reasons connected with the exclusive rights and that a change of contractor would cause significant inconvenience or substantial duplication of costs for the contracting authority.
vii.2.2:
This modification is necessary as additional time is required to conclude the current competitive tender process and award of the new contracts, and then to mobilise the new service safely. The current contracts are due to expire on 30th November 2024 so services beyond that date are not included in the current contract and the tender of services will not have been concluded prior to the contract expiry. There is a continued need for the services to satisfy the Council’s duties under the Care Act 2014 so they are ‘necessary’.

A change in contractor cannot be made for technical reasons at this stage as it would be very disruptive to vulnerable services users; there would be insufficient time to carry out care assessments and there would be significant TUPE complications.
A change of contractor would cause significant inconvenience or substantial duplication of costs for the contracting authority. It would be a significant administrative task to move the care packages over to new contracts in a short period of time including closing and reissuing purchase orders, as well as the commitment of social worker time that would be required to undertake each of these changes.
The increase in price does not exceed 50% of the value of the original contract.
