The technical services provided will primarily support the Circular Economy Activator workstream by helping ensure that supported SMEs have access to specialist sectoral and / or market knowledge to help with proof of concept and market validation that enables a more robust and demonstrable understanding of their anticipated market. This may include demand, barriers to entry, regulatory and permitting requirements, and the optimum route to market.

It may also be required, from time to time, to provide more specialist support to SMEs within both the Circular Economy Primer and the Circular Economy Implementation Support workstreams where this provide more effective and efficient delivery of the requirements.

The maximum value quoted for each contract and Lot is the same as for the overall framework agreement. For the avoidance of doubt, this is intended to reflect the absolute maximum that might be awarded to any framework supplier and / or through a Lot over the term of the framework agreement, including optional extension periods. Zero Waste Scotland does not commit to any minimum or maximum spend for any framework supplier or for any individual Lot - this will be determined through the appropriate call off processes.

The cumulative value of all concluded call off contracts shall not exceed the maximum value of the framework agreement.

seven.2) Information about modifications

seven.2.1) Description of the modifications

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

We are currently undertaking a review of our business support services, which includes a range of activities that could be considered part of the Circular Economy that were not necessarily included in the scope of the Circular Economy Business Support (CEBS) framework agreement. This review will help identify if and how business support services can be provided in future, whether through outsourcing or by in-house resources, which will support the development of a new procurement strategy for the tendering of new and / or replacement service provisions where appropriate.

This modification is being used to extend the period of the framework agreement only, until Tuesday 31 December 2024, with a single three (3) month extension option – to Monday 31 March 2025 – included for contingency purposes only. It does change the character of the original framework agreement or extend the scope of Services to be provided. There is also no change to the maximum value, which remains 5,000,00.00 GBP exclusive of Value Added Tax (VAT).

As such, the modification does not meet any of the conditions defined in regulation 72(8) of the Public Contracts (Scotland) Regulations and is therefore not considered substantial.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

The CEBS framework agreement is due to expire on Sunday 31 March 2024 and has no remaining options to extend the agreement beyond this date. While we cannot guarantee that further support services will be required, we consider a further extension to be prudent so that it can be used facilitate continued delivery of Services within the scope of the CEBS framework agreement in the event that those services become necessary before the establishment of new / replacement contracts.
