seven.2.1) Description of the modifications
Nature and extent of the modifications (with indication of possible earlier changes to the contract):
The contract is a call-off contract from the London Highways Alliance Contract Framework. The call-off contract is extended for 24 months from 1 April 2021 to 31 March 2023.
The contractor, Conway Aecom Limited, ceased to trade on 1 April 2021 or shortly thereafter and the call-off contract was novated to FM Conway Limited.
seven.2.2) Reasons for modification
Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee.
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:
The need for the extension of the contract has arisen from the Covid-19 pandemic. The Council's preferred strategy for delivery of the services post 31 March 2021 had to be delayed due to the pandemic. The Council's depot (which any insourced services would be delivered from) has been used for the Council's pandemic response. Additionally, the Council's financial position has changed as a result of the pandemic and further consideration of the affordability of options for delivery of the services going forward is necessary once the financial position is clearer. There was also a concern about potential lack of resources of bidders and Council officers to carry out the procurement of any new contract during additional waves of the pandemic.
