Explanation:
The OPONI rely on a derogation, in this case 32 (2) (b) (iii), due to technical reasons as Clue Computing Ltd own exclusive rights to the IL5 security level system which has been heavily bespoked for PONI and are the sole supplier for support, maintenance and licensing.
In addition for the additional licences it OPONI will also rely on the provisions of Reg 32(2)(b)(ii) on the basis of the technical compatibility requirements.
