seven.2.1) Description of the modifications
Nature and extent of the modifications (with indication of possible earlier changes to the contract):
The basis of the modification is that the supply of service remains necessary to meet the needs of people and carers living with
younger-onset dementia; and because there is an opportunity to make an efficiency saving which would carry significant risks if managed at the same time as a change of contractor.
seven.2.2) Reasons for modification
Need for additional works, services or supplies by the original contractor/concessionaire.
Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:
Under Regulation 72(1)(b) of the PCRs, contracts and framework agreements may be modified without a new procurement procedure, in certain circumstances, when provision of
a service is necessary and was not included in the initial procurement; and where a change of contractor would cause significant inconvenience or substantial duplication of costs. Any
modification under this provision must also be below 50% of the original contract value. It is proposed that the current situation meets these requirements for the following reasons:
i. The value of the contract from January 2018-September 2025 is a total of £2,350,033. Therefore the proposed modification, which would add £439,032 to the total value, represents an additional 18.7% over and above the current contract value.
This is well below the 50% threshold described in the relevant regulation.
