seven.2) Information about modifications
seven.2.1) Description of the modifications
Nature and extent of the modifications (with indication of possible earlier changes to the contract):
VII.2.2 Reasons for modification DHSC is relying on Regulation 72(1)(b) in order to modify the original contract:(a) Since the original contract was entered into, DHSC has become aware of additional requirements which have become necessary to improve the efficiency and to further automate elements of the flow wrap process. In particular to detect and automatically alert where cassettes have been incorrectly labelled “upstream on the production line” prior to flow-wrapping which is currently a manual procedure leading to reduced efficiency. (b) Paramount are providing an installation, integration and engineering support service for the flow wrappers already provided. It is reasonable therefore that a change of contractor should not be made “for economic or technical reasons such as requirements of interchangeability or interoperability with existing equipment, services or installations”. In addition, it could be argued a change of contractor could increase the associated risks of the operability of the production line were this to be split across multiple contractors.(c) A change of contractor could increase the associated risks of the operability of the automated production line were this to be split across multiple contractors, thus leading to the potential for “significant inconvenience or substantial duplication of costs”. (d) the modification does not alter the overall nature of the contract and the value of the modification is less than 50% of the original contract value.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:
DHSC awarded a contract on 21st December 2020 to Paramount Packaging Limited for the provision of flow wrapping machinery required for the manufacture of lateral flow test devices to support the UK Covid-19 testing strategy (Contract Award Notice reference 2021/S 045-114368). DHSC is extending the contract relying on Regulation 72(1)(b) of the Public Contracts Regulations 2015 to procure additional equipment to ensure the reliability and integrity of the operation of the secondary manufacturing production line.
