Babcock Land Defence Ltd, acting as agent for the UK Ministry of Defence, intends to negotiate a contract using the Negotiated Procedure Without Prior Publication pursuant to Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011 to Horstman Defence Systems Ltd on the basis that, for technical reasons, the Contract can only be awarded to Horstman Defence Systems Ltd.
Horstman Defence Systems Ltd, in its capacity as Design Authority, are the sole distributor of certain suspension components and associated items on the AS90, Bulldog, CR2 and Warrior and will only supply to the UK Ministry of Defence. They own the rights to the technical specifications required to undertake the manufacture, testing and supply. Horstman have stated that they are not willing to share this knowledge/expertise with any third party, including the UK Ministry of Defence. Without access to this, the UK Ministry of Defence is not in a position to be able to identify the exact technical requirements for the material or manufacture and as a result, Horstman Defence Systems Ltd are only able to fulfil this Contract.
