Computer Equipment and mobile devices using an Apple Operating System and value added services. The overall agreement encompasses various hardware, software, peripherals and accessories on which the Apple OS X, iPadOS and iOS operating systems (and future upgrades and derivatives) must run natively. The agreement also encompasses value added services (to be defined) as required.

The estimated spend of this framework agreement is circa GBP 500 million for the full term, inclusive of extensions.

Section seven: Modifications to the contract/concession

seven.1) Description of the procurement after the modifications

seven.1.4) Description of the procurement:

The framework agreement was initially awarded on the basis of 24 months with a further 2, 12-month options to extend. The options to extend have been exercised by the contracting authority. The framework agreement would expire on 31 March 2020 unless extended further.

Due to the Covid-19 pandemic, the authorities have insufficient time to re-procure the framework before its expiry. The Covid-19 pandemic is requiring IT providers to focus their supplies on study-at-home education needs and to a lesser extent, public health and NHS requirements. The closure of member institutions and restricted working arrangements for potential bidders has severely reduced the availability of IT provider and HE member institution personnel required to undertake the exercise. The lots, economic operators and nature of the supplies and services provided under each lot are unchanged. The estimated increased total spend through the framework agreement is less than 50 % of the value of the framework agreement.

The extension of a public sector contracting arrangement where there is a direct causal link to the Covid-19 pandemic is consistent with UK Government Procurement Policy Note 02/20 and Guidance from the European Commission.

The extension will until 31 July 2021 will provide sufficient time for the procurement currently ongoing for the new agreement.

seven.2) Information about modifications

seven.2.1) Description of the modifications

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

The framework agreement was initially awarded on the basis of 36 months with a further 12-month option to extend. That option to extend has been exercised by the contracting authority. The framework agreement would expire on 31st March 2020 and has been subsequently extended until 30th April 2021. This modification notice seeks to extend the agreement until 31st July 2021 to enable the procurement exercise in respect of a new agreement to be concluded.

Due to the Covid-19 pandemic, the authorities have insufficient time to re-procure the framework before its expiry. The Covid-19 pandemic is requiring IT providers to focus their supplies on study-at-home education needs and to a lesser extent, public health and NHS requirements. The closure of member institutions further prevents the hardware evaluation of bids. Potential bidders have also faced resource limitations due to furlough and socially distanced working which has impacted their ability to respond. The estimated increased total spend through the framework agreement is less than 50 % of the value of the framework agreement.

The extension of a public sector contracting arrangement where there is a direct causal link to the Covid-19 pandemic is consistent with UK Government Procurement Policy Note 02/20 and Guidance from the European Commission.

The new agreement is currently out to tender and is due to be awarded from 30th July 2021.
