Section four. Procedure

four.1) Description

four.1.1) Type of procedure

Award of a contract without prior publication of a call for competition in the cases listed below

  • The procurement falls outside the scope of application of the regulations

Explanation:

The Contract set out in OJEU Contract Notice was entered into by EANI as per the published Contract Award Notice. The Contract was initially for a term ending March 2021, with the option to extend for another 12 months. It was however agreed in February 2021 that the contract be extended until March 2022 and then further agreed in March 2022 that it be further extended until 30 September 2023 (Expiry) under Regulation 72(1)(B) of The Public Contacts Regulations 2015. Namely, the following conditions have been fulfilled:

For additional works, services or supplies by the original contractor that have become necessary and were not included in the initial procurement, where a change of contractor—

(i) Cannot be made for economic or technical reasons such as requirements of interchangeability or interoperability with existing equipment, services or installations procured under the initial procurement. EA’s finance systems are wholly reliant on the banking provider’s systems and a change of contractor now for a short period would have serious interoperability issues for the EA.

(ii) Would cause significant inconvenience or substantial duplication of costs for the contracting authority. It would cause substantial duplication of costs for the EA to move to another banking provider for a short period of time while the NI Public Sector Collaborative Tender concludes and EA onboards the resultant contract.

(iii) Provided that any increase in price does not exceed 50% of the value of the original contract. As the extension is estimated to be up to a maximum of approximately £645,000 GBP, it does not exceed 50% of the value of the original contract (£1,485,000 GBP).

EANI intended to on-board to the new NI Public Sector Collaborative Banking contract which was due to be awarded prior to March 2022. However delays to concluding this new contract has meant EA has not been able to commence onboarding of this contract as anticipated. During this Collaborative Banking tender process banks advised EA to retain a contractual relationship with its current banking provider to allow a “run down” process and to ensure continuity as all services are "run down" and transferred to the new contract. This modification period will allow all banking services to be transferred to the new contract without any break in service which would be ruinous for the EA in its ability to deliver services to NI Schools.

EANI anticipates that full banking services delivery will be transitioned to the new contracted supplier by September 2023, with services extended under the current contract until then.

The extension value is a maximum of £645,000 GBP.
