two.2.4) Description of the procurement
The Royal Navy, part of the UK Ministry of Defence, intends to intend to award a contract with a value of £175,000.00 to Materialise Motion, UK supplier Gait and Motion Technology Ltd to procure 2-m pressure plates. In accordance with the provisions of The Public Procurement (Amendment etc.) (EU Exit) Regulations 2020 SI No. 2020/1319, this procurement falls to be regulated under the provisions of the Public Contracts Regulations 2015 (PCR 2015) as amended (in particular by SI 2020/1319). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service (in accordance with the relevant legislation) is lawful in accordance with regulation 32(2)(b)(ii) of the PCR 2015.
The Authority intends to place this contract via a negotiated procedure without prior notice because competition is absent for technical reasons. Data relating to military movements (i.e., walking, marching, and running) was captured during a pilot RM Biomechanics Programme (RMBP), using pressure plates with unique sampling rate, resolution, software capabilities and plate size. This equipment and corresponding jig system has been developed and used in partnership with a cadre of seven academic establishments, who are trained in the analysis of data produced by these systems.
There is a compatibility requirement between MOD locations, and academic partners with the risk that using a different system would result in a loss in data validity and reliability. All previous work across the RN/ RM (BRNC and CTCRM) pilot has been undertaken with this pressure plate system and therefore it is vital to the ongoing success of the study that the data produced remains consistent. Changing to an alternate system could not be achieved without trialling and qualification of systems and modification of jigs. As the Authority wishes to continue the study of MSKI at pace, it considers the uncertainty around qualifying and modifying alternate systems as a risk, with no guarantee that the equipment could be qualified within our timeframe, or that data produced would be consistent. The Authority would need to able to build on the initial pilot data that is required to provide the calibration hub as part of the RN MMP’s measurement governance and assurance and views this as an intolerable risk to data integrity and its subsequent analysis and implementation.
