The service deliver a range of alternative approaches to providing access to education for young people who are excluded or at risk of exclusion, at risk of disengaging from mainstream school provision or otherwise require alternative education provision to meet their educational entitlement. The duration of the framework will be for 4 years with the option to extend up to 48 months.

The longer term of this ‘pseudo’ framework agreement which is required to enable the Council to gain best value from the investment in terms of time, money and resources in setting up this framework agreement.

Interest in this contract process should be expressed via the Council’s e-Tendering Portal – https://in-tendhost.co.uk/walsallcouncil The Council reserves the right to cancel the procurement and not to proceed with the contract. The Council will not, under any circumstances, reimburse any expense incurred by bidders in preparing their SSQ or tender submissions.In line with Regulation 76 of Public Contract Regulations for ‘Social and Other Specific Services’ the Council, as a contracting authority can determine the procedures that are to be applied in connection with the award of contracts as long as they ensure that they comply with the principles of transparency and equal treatment of economic operators. The procedure the Council has designed is that during the term of this framework agreement, the Council reserves the right to reopen the framework agreement for applications from new providers. This will be exercised where appropriate, for example, if additional capacity is required to meet the alternative education needs. This would not be a new procurement process; the terms and conditions and award criteria under the framework agreement will remain in place. The estimated value of £16,000,000 under section II.1.5) is based on an annual value of £2,000,000 multiplied by the maximum 8 year term (four year initial term plus 48 months extension options). Tenderers should note that if the council wish to carry out new services at the end of the contract, which are a repetition of the services detailed in this notice, then those additional services may be procured using the negotiated procedure without publication of a notice in accordance with regulation 32 (9-12) of the Public Contract Regulations 2015. If this procedure is utilised then the maximum value of this framework agreement could be £22,000,000 (8 year maximum contract value + 3 years continuation contract under Regulation 32 (9-12))

The Council will incorporate a standstill period at the point when information on the proposed award of the contract(s) is communicated to applicants. The standstill period, which will be for a minimum of ten calendar days, provides time for unsuccessful applicants to challenge the award decision before the contract is entered into. Aggrieved parties who have been harmed or are at risk of harm by any breach of the Council’s obligations may take action in the High Court (England, Wales and Northern Ireland).
