Explanation:
Underwater Electronic Warfare (UEW) in Maritime Combat Systems (MCS), which is part of the UK Ministry of Defence (MOD), proposes to place a contract with Thales UK Limited (Company Number 0868273) (“the Company”) for the supply of capability enhancements to the Sonar 2087 (S2087) System.
The Contract covers the supply of hardware and software (“the Goods”), which includes evaluating potential high-technology-readiness-level solutions from multiple original equipment suppliers (OEMs) by trialling their ability to interface with the S2087 System and deliver the required capability enhancements. When trials are successful, the Goods will be designed, built and installed on the S2087 System, which is in service on Royal Navy frigates.
The estimated value of the supply is £110M (one hundred and ten million pounds) and its duration is 3.5 (three-and-a-half) years with an option for a further 1 (one) year.
116 required capability enhancements have been identified for the S2087 System. The aim of the Project is to deliver as many capability enhancements as is reasonably possible within the timeframe and estimated value.
In accordance with regulation 4 of The Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this procurement falls to be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (in particular by SI 2019/697 and SI 2020/1450). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service (in accordance with the relevant legislation) is lawful in accordance with regulation 16(1)(b)(i) of the DSPCR 2011 for technical reasons. The Company is the only economic operator with the technical know how necessary to work closely with the MOD and OEMs to ensure the Goods are to the required standard of compatibility with the existing installed S2087 System. The Company designed, built and installed the S2087 System, and has continuously supported the System since it entered into service. The Company holds all the technical publications, performance data and drawings on the S2087 System and has unique knowledge and experience of its interfaces with the Royal Navy frigate Combat System Equipment and Combat System Highway.
