two.2.4) Description of the procurement

The provision of hosting and ongoing support for software in which the contracting authority holds a perpetual licence and which is used to support the administration of the Diabetic Eye Screening Programme by NHS Scotland which in turn delivers critical clinical services to citizens. The proposed contract will provide continuity of service based upon the existing solution in which there has been significant prior investment, development of expertise within the user community and on which the current operational processes through which the Diabetic Eye Screening Programme in Scotland is delivered rely. The Contracting Authority has embarked upon a programme of work which will consider how the national screening programmes should be supported by IT systems in the future. This contract provides continuity of service for the Diabetic Eye Screening Programme over the envisaged timescales for that review programme and any associated transition to successor arrangements arising from the outcomes of that programme. The contract will be for a period of five years with an additional two one year optional extensions at the discretion of the contracting authority.

As per Regulation 33 (1) (b) (iii). The provision of hosting and ongoing support for software in which the contracting authority holds a perpetual licence and which is used to support the administration of the Diabetic Eye Screening Programme by NHS Scotland which in turn delivers critical clinical services to citizens. Precise information on deadline(s) for review procedures

The notification will incorporate a ‘standstill period’ of a minimum of 10 clear calendar days (or a minimum of 15 days if the communication method used is not electronic) between the date on which the Authority despatches the VEAT notice and the date on which the Authority proposes to conclude the relevant contract.

The bringing of court proceedings against the authority during the standstill period will automatically continue the prohibition on entering into the contract until the court proceedings are determined, discontinued or disposed of, or the court, by interim order, brings to an end the prohibition. The remedies that may be awarded by the courts before the contract has been entered into include the setting aside of the decision to award the contract to the winning tenderer.

The bringing of court proceedings against the authority after the contract has been entered into will not affect the contract unless grounds for the imposition of special penalties under the Public Contracts (Scotland) Regulations 2015 can be established. Otherwise, the remedies that maybe awarded by the courts where the contract has been entered into are limited to the award of damages.
