Explanation:
The Department for Infrastructure will rely on a derogation- in this case regulation in this case Reg .32 2 b ii and iii) due to technical and economic reasons in that this is a business critical piece of software which DfI require under the European Flood Directive. The supplier hold proprietary rights to the software as the developer and do not licence their software to any third parties for re sale, development or support/maintenance.
