The provision of Osseointegration surgery for MoD patients who have had combat related injuries. Surgery shall be carried out by Military and Civilian Consultant Orthopaedic and Plastic Surgeons at the Royal Orthopaedic Hospital Birmingham (ROH) utilising military care and the assistance of a visiting orthopaedic consultant experienced in this technique. The surgeries will form part of MoD and NHS clinical evaluation.

four.1) Description

Explanation:
The Authority intends to place a contract with Royal Orthopaedic Hospital Birmingham (ROH) for the provision of Osseointegration for MoD patients that have had combat related injuries.
In accordance with the Public Procurement (Amendment etc.) (EU Exit) Regulations 2020 (SI 2020/1319) this procurement falls to be regulated under the provisions of the Public Contracts Regulations 2015 as amended (in particular by SI 2020/1319). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service (in accordance with Regulation 32(2)(b)(ii) of the Public Contracts Regulations 2015) is lawful on the basis that competition is absent for technical reasons.
The Authority considers that ROH is the only Contractor that has the necessary NHS surgical team with the required experience, skills and expertise to undertake this procedure, which is not routinely commissioned within the NHS.
The Authority also considers that the ROH is the only Contactor that has the required surgical capacity to undertake these procedures due to the Covid-19 backlog.
