seven.2.2) Reasons for modification
Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee.
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:
Due to release of 'outdoor learning' funding to schools as a result of challenges associated with COVID-19, an unprecedented number of orders have been raised against the contract. This is something that a diligent contracting authority could not have foreseen when the contact was initially put in place in 2018.
A new contract which has been competitively tendered is currently scheduled to commence on 1st April 22, however, this modification is to ensure contractual coverage for schools until the new contract commences.
A minor modification under PCR 2015 Reg 72, which increased the contract value by 10 percent (£13,000) of the original contract value (£130,000) was completed. This increased the contract value to £143,000. This further modification is to increase to contract value to £195,000. The total of all modifications from the original contract value is 50% and there will be no further modifications envisaged against this contract as a new contract is scheduled to commence on 1st April 2022.
This modification is in accordance with Regulation 72 (1) (c) and will comply with each of the following conditions pertaining to this regulation as outlined below:
(i) the need for modification has been brought about by circumstances which a diligent contracting authority could not have foreseen i.e. additional funding to schools for use on products or services related to outdoor wellbeing due to challenges associated with COVID-19.
(ii) the modification does not alter the overall nature of the contract (services provided will remain the same);
(iii) the value of the modification does not exceed 50% of the value of the original contract (value of proposed modification is 50% of the original contact value).
