The C-17 Command Support and Airborne Equipment Delivery Team (C17CSAE DT) as part of the UK Ministry of Defence (MOD) has a requirement to procure the through-life support for in-service Airborne Forces Equipment (AFE) and Airborne Delivery Equipment (ADE) parachute systems. This shall also include the procurement of capital spares, their components & ancillaries, and for technical advice.

two.2.4) Description of the procurement

The C-17 Command Support and Airborne Equipment Delivery Team (C17CSAE DT) as part of the UK Ministry of Defence (MOD) has a requirement to procure the through-life support for in-service Airborne Forces Equipment (AFE) and Airborne Delivery Equipment (ADE) parachute systems. This shall also include the procurement of capital spares, their components & ancillaries, and for technical advice.

It is intended to award a new contract up to the value of £10M with IrvinGQ Limited. It is intended this contract be let for two years with an option to extend for two separate periods of one year. A breakdown of contract value is as follows:

Contract year 1 and 2 £6M; plus

Contract option year 1 £2M; plus

Contract option year 2 £2M.

It has been determined that this contract can be placed using the Negotiated Procedure Without Prior Publication of a Contract Notice in accordance with Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011 (DSPCR 2011) for technical reasons due to IrvinGQ Limited being the sole Design Organisation (DO), and/or Original Equipment Manufacturer and sole distributor of items approved by the relevant system Coordinating Design Organisations, for the ADE, AFE systems. As such they are deemed by the respective Type Airworthiness Authorities (TAAs) and Engineering Authorities (EAs) to be the only Design Organisation Approval Scheme (DAOS) approved supplier that meets the Safety and Airworthiness requirements to provide and maintain the AE systems.

IrvinGQ Limited also holds the specific know-how, tools and proprietary information, in the form of the drawings setting out the design and engineering of the systems. This information is unavailable to other economic operators and the Authority does not have access to the drawing sets IrvinGQ Limited produced and uses to manufacture the equipment. Other providers would therefore be unable to replicate the systems, or items to support the systems, with certainty or provide the requisite safety assurances. It is considered that awarding a contract to any other organisation would present an unacceptable safety and airworthiness risk.
