two.2.4) Description of the procurement

Provision for the support for the delivery of Cataract procedures for the completed pathways, for all patients transferred via BCUHB up until 31st March 2025. Betsi Cadwaladr University Health Board (BCUHB) has identified the need for additional services to support its Elective Recovery Plan. The short-term goal is increasing capacity to address the backlog of patients who have been waiting more than 52 weeks from referral.

It is anticipated that the contract will be completed by 31st October 2025 however this contract will allow for the provision of services as detailed in this Notice until 31st March 2026

Section four. Procedure

four.1) Description

four.1.1) Type of procedure

Negotiated without a prior call for competition

  • The works, supplies or services can be provided only by a particular economic operator for the following reason:
    • absence of competition for technical reasons

Explanation:

It is considered that this contract can be placed using the negotiated procedure without prior publication of a contract notice pursuant to Article 32(2)(b)(ii) of the Directive 2014/24/EU (Regulation 32(2)(b)(ii) of the Public Contract Regulations 2015). This is for technical reasons in that this contract may not be awarded to any other particular economic operator.

This contract will commence from 1st April 2025 and will be for the completion of patient’s cataract pathway for the cohort of patients transferred to New Medical Systems Ltd under the current contract, reference - BCU-DCO-57781 which was a short-term contract from 13th December 2024 to 31st March 2025 to treat long waiters on BCUHB cataract waiting lists. Due to delays in transferring the patients to the provider and the need to give reasonable offer to the patients it is impossible to schedule the full cohort within the contract timeframe, to transfer patients back to BCUHB on 1st April 2025 would be detrimental to their medical care.

The full cohort of BCUHB patients will have been transferred to New Medical Systems Ltd before 21st of February 2025 with the over 104 week wait patients being the priority to be seen and treated in the period up until 31st March 2025. No further patients will be transferred and this contract will be solely for the current patients’ completion of treatment/ full pathways
