two.1.4) Short description

BHC is seeking to enter into an agreement with a supplier for the supply of a pilot boat. BHC wishes to acquire and commission a pilot boat for the transportation of pilots between Belfast Harbour and vessels in Belfast Lough. BHC may (at its discretion) require maintenance and/or spare parts for the pilot boat from the successful bidder. Bidders should note that the supply of maintenance services (if any) is not an immediate requirement, however BHC wishes to retain the option to purchase such services from the successful bidder for a period of up to 10 years following supply of the pilot boat. Bidders should note that the estimated total value set out below represents BHC's best estimated contract value taking into account all supply options which may be included in the contract, but excludes the value of any maintenance services and/or spare parts, which value cannot be estimated at this point. Further information will be supplied to shortlisted bidders at the tender stage.

two.2.4) Description of the procurement

Both within and outside of the warranty period BHC must be able to call upon the successful supplier (via its appointed agent if appropriate) within a reasonable timeframe (according to the urgency of the support issue) to provide on-site technical assistance. BHC is reviewing its requirements in this regard but currently anticipates that the timeframe(s) proposed may be evaluated at the next stage of the tender process. Bidders should note at this stage that the successful supplier will be required:

(a) to be available on-site to provide technical assistance in relation to the drivetrain (which incorporates the gearbox, shaft and propellers), engine, other critical systems or hull damage within 48 hours of BHC's request;

and

(b) to supply any spare parts required by BHC in a timely fashion.

The pilot boat must comply with the minimum requirements of the Small Commercial Vessel and Pilot Boat Code of Practice and be issued with a construction certificate from a recognized UK load line assigning authority (as detailed in Section 4.2.2.4 of the Code). The pilot boat shall be delivered fully operational and coded for use at the earliest possible date. BHC is considering its requirements in this regard but currently anticipates that the timeframe proposed by the bidder may be evaluated at the next stage of the tender process and that a maximum acceptable lead time for supply of 24 months from the tender return deadline will be required.

The pilot boat particulars are as follows:

Classification and Coding

The vessel will be registered in Belfast and must be constructed, equipped and outfitted in accordance with and to the highest standard required by:

• The UK Maritime and Coast Guard Agency Code of Practice for the Safety for Small Commercial Vessels and Pilot Boats - The Workboat Code Edition 2 Amendment 1. Built as a dedicated pilot boat and capable of operating in category 2 waters (60 nautical miles from a safe haven).

• Classification Society Rules.

• ISO 12217 Design Category

This specification should be read in conjunction with these standards. In the event of any conflict between BHC's specification for the pilot boat and these standards, the applicable standards shall prevail. Further details of BHC's requirements are contained within the Pre-Qualification Questionnaire.

Objective criteria for choosing the limited number of candidates:

Subject to a sufficient number of compliant responses being received, BHC intends (according to the process described below) to invite a maximum of the top 4 ranked compliant bidders, following evaluation of PQQ responses, to the invitation to negotiate stage of this process, provided that BHC, acting at its discretion, reserves the right to invite less than 4 bidders to negotiate. Where there is a tie for 4th place, all bidders in 4th place will be invited to negotiate. For the purposes of the exercise, a tie for 4th place is deemed to occur where two or more bidders have identical scores.

BHC will incorporate a minimum 10 calendar day standstill period at the point information on the award of contract is communicated to all bidders. The standstill period provides time for unsuccessful bidders to challenge the award decision before the contract is entered into. The Utilities Contracts Regulations 2016 (as amended) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (Northern Ireland).
