four.1) Description

four.1.1) Type of procedure

Award of a contract without prior publication of a call for competition in the cases listed below

  • The services can be provided only by a particular economic operator for the following reason:
    • absence of competition for technical reasons

Explanation:

Technical aspects; interoperability and economic reasons made competitively tendering for only part of the WAN an unrealistic option.

Unnecessary duplication of equipment, circuits and technical resource costs in the order of between £150k to £200k to achieve a workable technical solution of a split provider WAN network, meant that this was not a value for money (VfM) proposition and service/issue/escalation management of two suppliers would also be an added risk.

The CSU having assessed technical reasons, economic reasons (VfM) and compliance aspects considered that the only reasonable course of action was to direct award expiring circuits within its current WAN estates so as to co-term with other in-contract circuits by 31st March 2024. This will enable the CSU to tender for all WAN services in their entirety during 2023 and mobilise before March 2024 contract end date.
