Explanation:
The Ministry of Defence intends to award a contract for
The Provision of the Load Effects Assessment Program (L.E.A.P) to Human Systems Incorporated using the negotiated procedure without the prior publication of a contract notice under Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011 (SI 1848) (Article 28(1)(e) of Directive 2009/81/EC). This is on the basis that for technical reasons the Contract may be awarded only to the Supplier.
It is considered that this contract can be placed using the negotiated procedure without prior publication of a contract notice pursuant to (Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations (DSPCR of 2011) for the following technical reasons:
- HSI are the only economic entity with the expertise to undertake this requirement and the only entity that has the required NATO accreditation.
- UKMOD considers that it would be technically impractical for another entity to develop an equivalent system and achieve NATO accreditation within the timescales required.
