Explanation:
1. The United Kingdom Ministry of Defence (the “Authority”) intends to place a new design and build contract with Devonport Royal Dockyard Limited (the “Company”) to support the 10 Dock and 5 basin berth construction at Devonport Royal Dockyard specifically for a O2 workshop. This contract is a call off from the current Integrated Partner Framework, NEC 4 which was signed between the Authority and the Company in December 2020 for both the assessment and construction phases of the works at Plymouth Naval Base to facilitate berthing and docking for deep maintenance period of Astute Class submarines. The value is estimated at £3.7 million and the expected duration is 24 months.
2. In accordance with regulation 4 of The Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this procurement falls to be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (in particular by SI 2019/697 and SI 2020/1450). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service is lawful in accordance with Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011 for technical reasons as the Company is the only supplier able to meet the requirement.
This is because the works will be carried out on a site owned by the Company, which is its nuclear licensed site for which it is the on-site nuclear regulator. Also, only the Company has the necessary knowledge (and potentially capability) required to advance the assessment phase to the required levels of maturity and the construction of the O2 workshop.)
