seven.2.1) Description of the modifications
Nature and extent of the modifications (with indication of possible earlier changes to the contract):
The supply and delivery of traffic signs and posts for the Department was originally contracted to two suppliers, with items distributed across sixteen lots, with each supplier being awarded eight lots each.
The Department has modified this contract to permit PWS Ltd to supply items across all sixteen lots until the end of the contract period in October 2024.
seven.2.2) Reasons for modification
Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee.
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:
The supply and delivery of traffic signs and posts for the Department was originally contracted to two suppliers with items distributed across sixteen lots, with each supplier being award eight lots each.
The Department terminated the contract with the other supplier in accordance with the Northern Ireland protocol for managing supplier poor performance. This action is very uncommon and was not foreseen by the contracting authority.
It was necessary for the Department to modify this contract to ensure the availability of safety-critical road signage until a replacement contract is procured.
The Department has commenced the development of a procurement competition to provide replacement contracts, which will be awarded by October 2024.
