Procedure

Procedure type

Direct award

Direct award justification

Switching to direct award

This procurement did not proceed to a competitive tendering procedure as the requirements could only be met by a single supplier holding manufacturer-confirmed exclusive rights to the specific operating table system and associated proprietary accessories.

Competition was therefore not viable, as alternative suppliers could not meet the Trust's clinical, technical and standardisation requirements without introducing incompatibility and clinical risk. Accordingly, the Trust proceeded directly to a lawful direct award in accordance with Schedule 5, Paragraph 6(a) and 6(b) of the Procurement Act 2023.
