four.1) Description

four.1.1) Type of procedure

Negotiated procedure without publication of a contract notice

Explanation:

The Typhoon Delivery Team, part of the UK Ministry of Defence intends to extend the current FAST/00156 with Fujitsu Services Limited for software and hardware support and enhanced warranty to the Typhoon Iso Team, and warranties for NETAPP (Memory Banks that are attached to the servers as part of the Engineering Support System (ESS)) and Typhoon Training Flight (TTF) at RAF Coningsby and RAF Lossiemouth for a duration of seven months effective from April 1st 2021 – 31st October 2021. This contract extension will have a maximum value of £167,239.07 over the seven-month period. It is considered that this contract extension can be placed with Fujitsu Services Limited using the negotiated procedure without prior publication pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulations 16 (1)(a)(ii) of the Defence and Security Public Contract Regulations 2011). This is for the following Technical Reasons: BAES are an approved design organisation under the Military Aviation Authority’s Design Approved Organisation Scheme (DAOS) and within that approval are listed as Senior Design staff with approval to certify Design Certificates for Typhoon software and Hardware. The Military Aviation Authority (MAA) requires that this DAOS approved organisation has extensive Typhoon Engineering Support Subsystem design experience and this currently cannot be achieved outside of the BAES environment in the case of UK ESS. BAES as the Design Authority determine the type and specification of the hardware we require, which is signed off by the Design Authorities safety and Airworthiness team. The support element alongside the warranties are to be placed with Fujitsu Services Limited, as they are the only supplier authorised by BAES to supply System Design Authority approved equipment and spares support to assure the validity of the design and use criteria detailed in the Declaration of Design and Performance (DDP) which covers the safety and airworthiness of the product and therefore the platform. In addition, Fujitsu Services Limited are the Manufacturer and Supplier of the hardware used at UK Main Operating Bases (MOBs), and therefore are the only supplier with the required Subject Matter Experts able to sustain the integrity of the systems. Furthermore, Fujitsu Services Limited is the only supplier possessing the specific know-how required to support the equipment and provide airworthiness, spares and specific knowledgeable engineers. In addition, due to the ESS’ critical nature within the Typhoon Operation as a Safety and Airworthiness system, it is not possible to swap equipment as this would invalidate the Declaration of Design Performance and therefore presents intolerable potential Safety and Airworthiness and Security risks.
