four.1) Description

Explanation:

Fife Council has an immediate requirement for the supply of lanterns as part of their lanterns renewal programme to be delivered by the end of March 23. The lanterns have a lead time of 6 to 8 weeks. The client already has contractors in place to start the work by the end of March 23.

If we are unable to purchase lanterns, we would have to stop our column replacement programme and in extreme cases may have to cut down columns for safety reasons and not be able to replace them.

The work of replacing columns deemed to be structurally unsound is crucial as failure to do so creates a risk to the public leaving aluminium columns which need replaced are left. This will pose a risk to public safety, social inclusion, and quality of life.

The value of this immediate need from the Lantern Renewal programme (300k GBP) is over the regulated financial threshold for materials set out in the Fife Councils Scheme of Tender Procedures (50k GBP). Our preferred route to market was through a Scotland Excel framework which has not been possible due to current framework lapsing and new framework yet established to replace this.

Fife Council is looking to award this work through a Negotiated Without Call for Competition Procedure for a short period until a new framework is established under 33(1)(c) in the Public Contract Scotland Regulations 2015:

(c)where (but only if it is strictly necessary) for reasons of extreme urgency brought about by events unforeseeable by the contracting authority, the time limits for open procedure, restricted procedure or competitive procedure with negotiation cannot be complied with.
