National Highways intends to procure an Owner Controlled Insurance Programme (OCIP) to fulfil the insurance requirements for Lower Thames Crossing (LTC).

The Lower Thames Crossing is part of the biggest investment in the UK roads for a generation. It consists of a proposed new All Purpose Trunk Road connecting the A2/M2 in Kent, crossing under the Thames through a twin-bored tunnel before joining the M25 south of Junction 29.

This Prior Information Notice ('PIN') is to alert parties that National Highways wishes to commence pre-procurement market engagement and consultation, to inform the development of National

Highways' procurement strategy for OCIP.

Through this market engagement exercise, National Highways wishes to the gain an understanding on following:

• The insurance market dynamics

• Market appetite to provide insurance cover in relation to an LTC OCIP relating to construction /infrastructure insurances.

• The Insurance markets view on any concerns with the procurement strategy and how these concerns can be mitigated

At present, the classes of insurance anticipated to be included in the LTC OCIP are:

• Construction "All Risks" Insurance (CAR)

• Tunnel Boring Machine "All Risks" Insurance (TBM)

• Construction Third Party Liability Insurance (CTPL) and

• Contractors Pollution Liability Insurance (CPL)

Instructions for completing National Highways' market engagement exercise:

1)The target audience for this market engagement are insurance companies who are regulated by the Financial Conduct Authority, Financial Services and Markets Act 2000 and any other statutory modifications. The insurers will also have the authority to write the classes of insurance listed in this PIN, within the United Kingdom subject to English law and jurisdiction of English courts.

2) National Highways will use our e-Sourcing Portal Jaggaer to communicate and undertake market engagement activities with those parties interested in participating in the market engagement for OCIP.

3) If you are interested in participating please register on Jaggaer, by visiting www.highways.bravosolution.co.uk,(ITT_6740).

Once you have registered, please send an email to the LTC procurement manager Yasmine Bains,

You will then be added to the "ITT_6740 Insurance Market Engagement for Lower Thames Crossing (LTC) Owner Controlled Insurance Programme (OCIP)", where your party will be able to review the LTC Market Sounding Briefing pack and respond to the Insurance Market Sounding Questionnaire.

4) Please complete and return the Insurance Market Sounding Questionnaire via the Jaggaer messaging system by noon on the

25th March 2022.

5) All parties who complete the Insurance Market Sounding Questionnaire will receive an invite to participate in a follow up meeting. The purpose of the follow up meeting is for National Highways to understand and listen to what interested parties have to say, and use this feedback to shape the procurement strategy for OCIP.

six.3) Additional information

1. This PIN is issued solely for the purpose of commencing a market consultation exercise and does not constitute any commitment by National Highways to undertake any public procurement exercise.

2. This PIN does not constitute a call for competition, to procure any works or services and is not published to reduce time limited for the receipt of tenders.

3. Non-participation in the market engagement exercise shall not prevent any party from participating in the procurement.

4. All responses will be carefully considered by National Highways when finalising the LTC OCIP procurement strategy, but the responses received will not bind National Highways to any procurement approach, award criteria or award decision.

5. National Highways will not be liable for any costs, fees or expenses incurred by any party responding to this PIN or any party who may participate in the market consultation exercise.

6.The Insurance Market Sounding Questionnaire does not form part of any regulated procurement process.

7.The Market Sounding Briefing pack, and all information contained within the briefing pack is confidential and should not be circulated more widely without National Highways' express written consent.

All information provided is the property of National Highways and may be used only for the purposes of responding to the Insurance Market Sounding Questionnaire.

8. All responses received to the Insurance Market Sounding Questionnaire will be treated in confidence. National

Highways will use the responses to compile a market engagement report, to detail the outcome of the market engagement exercise.

9.The market engagement report will contain non-attributable and aggregated data. The report will be shared internally within National Highways; and may also, notwithstanding the stated confidentiality of

responses, be disclosed to National Highway’s external advisors for the LTC Project.
