four.1) Description

four.1.1) Type of procedure

Award of a contract without prior publication of a call for competition in the cases listed below

  • The procurement falls outside the scope of application of the regulations

Explanation:

The leisure services contract for Maidstone Leisure Centre, Mote Park Outdoor Adventure and Lockmeadow Health Club is being extended from August 2024 for a period of five years, with up to three one-year extensions thereafter. The reasons for this are as follows;

• The contract extension and the variable end date of the extension period allows Maidstone Borough Council (the Council) to be flexible and agile in its planning for the future of the leisure centre

• The contract extension allows for further development of plans for the re-building or renovation of the existing leisure centre

• The contract extension will set leisure provision by the Council on a sustainable and consistent footing for five to eight years.

• The Council will develop detailed plans and a planning application for a future leisure centre, refurbished or redeveloped, which will be put out to tender

• Maidstone Leisure Trust is an independent not-for-profit community benefit society which gives the Council significant tax exemptions and other benefits

• Any new tender would be for a short period on an ageing building. It is unlikely to be appealing to operators in the current market who are likely to want a longer tenure and a commitment to operating the current premises and the new premises

• The contract extension is in line with Reg 72.1.c;

(i)the need for modification has been brought about by circumstances which a diligent contracting authority could not have foreseen (the ongoing effect of COVID on the leisure market);

(ii)the modification does not alter the overall nature of the contract (the overall nature of the contract will not be altered);

(iii)any increase in price does not exceed 50% of the value of the original contract or framework agreement (this is the case).
