three.1.4) Objective rules and criteria for participation

List and brief description of rules and criteria

Insurance obligations for the Provider include:

Third Party (Public) liability to a minimum indemnity limit of 10 million GBP each occurrence. Liability must not exclude abuse and/or molestation cover.

Where required, employer’s liability to a minimum indemnity limit of 10 million GBP each occurrence

Where a vehicle is used in the delivery of the Service, statutory third party motor vehicle liability insurance to a minimum indemnity of 5 million GBP each occurrence;

Professional indemnity to a minimum indemnity of 5 million GBP each occurrence.

A search of the bidder against Equifax’s Protect must not return a ‘Warning’ or ‘Caution’ returnable code, unless alternative documentation is made available to Scotland Excel as stated in Regulation 61 (Means of Proof).

three.2) Conditions related to the contract

Registration with the Care Inspectorate and Scottish Social Services Council in accordance with Regulation of Care (Scotland) Act 2001 as amended.

Bidders should provide Registration number(s) etc at Section 4A.2 in the SPD.

three.2.2) Contract performance conditions

Where a Service receives a grade of three (3) or less for the ‘Care and Support’ quality theme (as used by the Care Inspectorate) that Service will be given an opportunity to improve this grade through a robust improvement plan agreed with the Care Inspectorate. Failure to improve grades may result in temporary Suspension of the Provider from participation in whole or in part in the Framework Agreement.

The scope of services to be provided under this Framework Agreement falls within the definition of social and other specific services in Schedule 3 to the Public Contracts (Scotland) Regulations 2015 ("the Regulations") and therefore the procurement process shall be subject to the requirements of section 7 of the Regulations.
