Description
Cartrefi Conwy requires comprehensive insurance coverage to protect its assets, operations, and liabilities. The current insurance policy is due to expire in December 2025. A competitive procurement procedure was planned in accordance with the Procurement Act 2023; however, during market engagement in July 2025, potential bidders confirmed that the contracting authority does not hold sufficient data to inform bidders of its insurance needs and enable competitive bids.
Specialist consultants were engaged to collate the necessary data, but due to the complexity and volume of information required, this exercise cannot be completed before the expiry of the current policy. Without adequate insurance, Cartrefi Conwy would face significant operational and financial risk.
Given these circumstances, there is an absence of competition for technical reasons: only the incumbent provider, who holds the relevant historical data and understands Cartrefi Conwy’s insurance requirements, can supply the services needed. There is no reasonable alternative to the insurance cover required. The proposed direct award will provide a 12-month bridging contract, ensuring continuity of cover while enabling completion of the data-gathering exercise and preparation for a fully compliant competitive procurement process.

Single supplier - technical reasons
The contract is being awarded directly to a supplier that is not an excluded supplier because a direct award justification applies in accordance with section 41(1)(a) of the Procurement Act 2023.
The direct award justification at paragraph 6 of Schedule 5 of the Procurement Act 2023 applies to the award of the contract.
The contracting authority commenced engagement with the market regarding the procurement of insurance services and award of the contract in July 2025 (with a planned contract start date of 31 December 2025).
During such market engagement, potential bidders confirmed that the contracting authority does not currently hold sufficient data/information to inform bidders of its insurance needs and to enable bidders to submit bids in a competitive procurement procedure.
The contracting authority promptly engaged consultants to collate the relevant data/information however, given the extent of the data/information required, such data information is yet to be finalised.
Accordingly, there is an absence of competition for technical reasons (insufficient information/data available for bidders). Given the feedback received during market engagement, the contracting authority considers that the only supplier able to supply the insurance services required is the current provider who is content to proceed on the basis of the information/data it holds relating to previous policies.
There is no reasonable alternative to the insurance cover which the contracting authority requires.
