Natural Resources Wales has a Metal Mine Strategy that focuses attention on the impacts on our failing waterbodies where over 700km of river reaches are failing chemically and/or ecologically in accordance with the Water Framework Directive. This contract is to extend the collaborative partnership with the Coal Authority to progress the assessment and remedial work at selected metal mines.

two.2.4) Description of the procurement

NRW has a Metal Mine Strategy that focuses attention on the impacts on our failing waterbodies where over 700km of river reaches are failing chemically and/or ecologically in accordance with the Water Framework Directive.

Our Metal (Non-Coal) Mine Programme is receiving capital funding from the Welsh Government to progress assessment and remedial work at selected metal mines. The Programme Board receives delivery, technical authority and specialist advice from members including Welsh Government, NRW and the Coal Authority. This Board makes decisions on the work programme progressing each year.

NRW’s existing technical authority (Geoscience) and specialist resources in-house are insufficient to exploit the full benefits potential in developing further and delivering a programme of this scale and technical nature.

In England, similar work is carried out by the Coal Authority through a direct government to government agreement between DEFRA, the Coal Authority and the Environment Agency. In the 2020/21 financial year, NRW implemented a similar arrangement with the Coal Authority for this programme.

NRW now wishes to continue the relationship with the Coal Authority for a further five years, until the end of the 2025/26 financial year.

four.1) Description

four.1.1) Type of procedure

Explanation:

This arrangement is in accordance with Regulation 12(7) of the Public Contract Regulations (2015) which allows Natural Resources Wales and the Coal Authority to work collaboratively under a public sector-to-public sector agreement to deliver on a metal (non-coal) mines programme of works for Wales.

NRW is seeking to continue the partnership with the Coal Authority to help maintain a Board structure that is technically competent in the fields of mining, mine hazards and treatment of non-coal mine discharges, whilst ensuring there is the necessary governance in place.

The programme will be directed by the Board, managed by the Programme and Project Delivery team and technically steered by the Geoscience team within NRW. To deliver a programme of work in this sector NRW requires a partner that has capacity and has mine-sector specific framework contracts to effect multi-disciplinary delivery of a large number of projects that is supported by an RD&I programme focusing on mine restoration, stabilisation/remediation and mine water treatment.

This partnership allows public sector procurement through the Coal Authority's bespoke frameworks, but also provide the opportunity for NRW to use and develop its own frameworks or conduct open competitions where appropriate. This partnership enables the programme to be delivered more effectively and projects within a shorter timescale.
