four.1) Description
four.1.1) Type of procedure
Award of a contract without prior publication of a call for competition in the cases listed below

Explanation:
In 2019, The Housing Executive tendered Contracts for the Provision of Mechanical and Electrical Servicing & Maintenance for Offices and Hostels through two tender packages; CT047 – Facilities North Region (Facilities Section) CT074 – Facilities South and Belfast (Facilities Section). The Contracting Authority awarded the CT047 – Facilities North Region (Facilities Section) Lot to B.I. Electrical Services (N.I.) Ltd. on 17th September 2019 following a competitive procurement process conducted on eTendersNI. The other Lot was not awarded and subsequently re-advertised as project number CTO74 via eTendersNI.
The contract commenced in December 2019 with a contract term of two years with the option for it to be extended up to a maximum period of 24 months or part thereof, at an estimated total value of £4,000,000.00. However, the OJEU Value was set at £3,186,924 for a Service contract. Following the initial two-year contract period, each contract was extended by 18 months, giving a total contract period of 42 months, and a completion date of May 2023. A procurement process is currently under way for a replacement contract. In June 2022, following restructure and the introduction of the new Building Safety Department, the three Mechanical and Electrical Servicing & Maintenance Contracts transferred to Building Services, within Building Safety, and cost review was undertaken.
The approved Contract Value will be increased by less than 10%. It exceeds the threshold for a Service contract. This modification does not materially alter the nature of the contract, nor does it introduce any conditions that would have allowed for the admission or acceptance of a different tender. Furthermore, the modification does not exceed 50% of the value allowed by regulation 72 (5). Services have been identified for this additional expenditure and will be issued to contractor.
Due to the complexity and variety of the property stock ongoing additional unforeseen works were necessary which were not anticipated at the time of tender and occurred throughout the contract period. This included repairs and needs led modifications / additions to existing systems and equipment to ensure the buildings were safe to occupy. The provision of this requirement is critical to enable the Contracting Authority to discharge its statutory housing duty.
No change to the scope of works required within the contract will occur during the contract period. The works associated with the additional expenditure are necessary to prevent the stoppage of a strategically critical service whilst the Contracting Authority undertakes a compliant procurement project for Mechanical and Electrical Services. This is a temporary measure which will only be availed of until the new Contract is in place. Tenders have been returned and are currently being evaluated.
