Explanation:
Given the lack of alternative providers in the market, and the importance of ensuring continuity of services for vulnerable children this Direct Award has been put in place.
The contract with Bullfrog Arts was not formally extended before its expiration due to a clerical error, therefore this direct award has been put in place with consideration that the conduct of both parties and the fact that the contract was originally awarded following a compliant procurement process. The continued provision of services by Bullfrog Arts and the Council's acceptance of these services demonstrate an implied continuation of the contractual relationship. This continuity, combined with the original procurement process is a mitigating factor. No further amendments to the original contract have been made.
