Explanation:
This contract is awarded in accordance with the following derogations under the regulations:
I. Where competition is absent for technical reasons (regulation 32(2)(b)(ii);
II. For reasons connected with the protection of exclusive rights, including intellectual property rights (reg32(2)(b) iii) but only where no reasonable alternative or substitute exists and the absence of competition is not the result of an artificial narrowing down of the parameters of the procurement.
The local DNA management system is a bespoke and integral part of the FSNI DNA profiling service required by PSNI under the Criminal Justice and Police & Criminal Evidence Act (PACE). IPR relating to the approaches, coding methodologies, techniques and tools for matching and processing suspects belong to the Economic Operator. This direct award contract will allow for ongoing maintenance, service development and ensure ongoing availability and functionality.
